of Galifornia, according to map thereof No, 15407, filed in the office of the County Recorder of
San Diego County, August 9, 2006.
In consideration of approlial by the City of poway ("CITY" hereinafter) of a Building
Permit for an atta9hed, 810-sq~ace,footguest house, OWNER hereby agrees that the guest
house shall,neverbe.rentedorfeased:as a separate unit, no complete kitchen facilities shall be
installed, and'ho gas line ahd/or"220 ampere electrical service shall ever be installed, except for
that to be used solely for water heater and heating purposes.
This Covehant shall run with the land ahd be bindihg upon and inure to the benefit of the
future owners"encumbrances, successors, heirs, personal representatives, transferees, and
assigns onhe respective parties.
In the event that a Building,Permit is never obtained to construct the detached accessory
structure at the request of the OWNER, the CITY shall expunge this Covenant from the record
title of the PROPERTY,
If either party is required to incur costs to enforce the provisions of this Covenant; the
prevailing 'party shall be entitled to full reimbursement of all costs, including reasoo<!ble
attorneys' fees, from the-other party:- The- CITY' may assign to persons impacted by the
performance of this Covenant the right to enforce this Covenant a9ainst the OWNER.
