COVENANT REGARDING REAL PROPERTY
Vincent R Vawter and Kimberly P. Vawter, trustees of the Vawter Family Trust dated
December 27, 2005, are the owners of real property ("OWNERS" hereinafter), commonly known as
15795 Dovewood Court ("PROPERTY hereinafter), and more fully described as'
Lot 67 of the City of Poway Tract No. 3545, in the City of Poway, County of San Diego,
State of California, according to map thereof No, 10432, filed in the Office of the County
Recorder of San Diego, July 15, 1982,
In consideration of the approval of a Building Permit to construct an 861-square-foot, detached
garage with a 465-square-foot guest house attached to it on the referenced property by the City of
Poway ("CITY" hereinafter), OWNERS hereby agree that the guest house shall never be rented or
leased as a separate uriit, no complete ~itchen facilities shall bednstalled, and no gas line and/or 220
ampere electricai service shall'everbe instalied,
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that a Building Permit is never obtained to construct the proposed guest house at
the request of the OWNERS, the CITY shall expunge this Covenant from the record title of the
PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party, The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OWNERS,
