Andrew Kytasty and Ingrid Christine Kytasty, Trustees of the Andrew Kytasty and Ingrid
Christine KytastyFamily Trust UIDfT July 15, 1986 ("OWNER" hereinafter)" is the owner of real
property commonly known as' 18.372 Deer Valley Estates ("PROPERTY" hereinafter), and more
fully described in Exhibit A.' '
In consideration of the approval of a Building Permit by the City of poway ("CITY"
hereinafter) to constru~~ a replacement r,esidence attbe above-referenced Witch Creek Fire
impacted property, which wilLinclude a 1,400-square-fooUower,level, OWNER hereby agrees that
the lower level shall never be converted to habitable sp'ace with'out first obtaining approval and
appropriate permits from CITY,
This Covenant shall run with the land and be binding upon ,and inure to the benefit of, tj1e, "

request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY '
If either party is required .to, incur costs to enfor,cethe pr.ovisions of this Covenant, the
prevailing party shall be entitled to fullreilllbursemef1t of all. costs, including reasonable attorneys'
fees, from the other party. The CITY l1layassign to personsi[11pacted by the performance of this
Covenant the right to enforce this ,Covenant against the OWNER,
