COVENANT REGARDING REAL PROPERTY
Elwood'G. Norris and Stephanie Anne/Norris, Trustees"of the'Norris Family 1997 Trust Dated
November 5, 1997, and'EGN Holdings, LLC, PROPERTY OWNERS ("OWNER" hereinafter), are the
owners of real property commonly known as 16101 Blue Crystal Trails CPROPERTY" hereinafter),and
more fully described in Exhibit A.
In considerationofthe,approval by the City of PowayCCITY" hereinafter) of oj Building Permit
for the construction of an approximate 7,056-square-foot recreational building and a 2,254-square-foot
carousel building, OWNER herebY a'grees that no portion of the recreational building or carousel
building shall ever be rented or leased as a separate unit or used as a commercial facility,
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the, event of litigation to enforce.the provisions of this Covenant, the prevailing party shall be
entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the 'other party.
