A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING CONDITIONAL USE PERMIT 88-03
AND MINOR DEVELOPMENT REVIEW 88-56 I
ASSESSOR'S PARCEL NUMBER 317-540-26
WHEREAS, conditional Use Permit 88-03 and Minor Development
Review 88-56, submitted by Antal Borsa, applicant, requests the
approval 1,440 square foo,t quick lube. service building on a
freestanding pad in a recently approved commercial center at. 12469
Poway Road, in the CG (Commercial General) zone; and--
WHEREAS, onpune 7,1988, the City Council held ~duly adver-
tised public hearing-to solicit comments from the public, both pro
and con, relative to this application. I

NOW, THEREFORE, the Ci ty Counc i 1 does hereby res'ol ve as
follows:
Section 1: Environmental Findings:
The City council finds that this project will not have a signi-
ficant adverse impact on the environment and hereby issues a
Negative Declaration.
Section 2: Findings:
Conditional Use Permit 88-03
1.
That the location, size. desigh, and operating charac-
teristics of the proposed use will be compatible wIth and
will not adversely affect or be materially 4etrimental to
adjacent uses, residents, buildings, structures, or natural
resources, in t~at the proposed use will b~ limited in
scope of opera.tion concerning generation of noise, and
hours of operation, and the use, storage, and disposal of
auto fluids.

That the harmony in scale, bulk , coverage, 'and densi ty is
consistent with. adjacent uses, in that the Inew building
will be architecturally integrated with the approved com-
mercial center i including building ,materia~s, coloration,
and landscaping,
3, That there are available public facilities: services, and

4 ,
That there will not be a harmful effect updn desirable
neighborhood characteristics since construction of the new
building will require the erection of a six foot masonry
wall to screen service bays from views in all directions,

Poway General Plan for future as well as present develop-

commercial uses,
Minor Development Review 88-56
1, That the proposed development is in conformance with the
Poway General ~lan because the General plan designates the
site for commercial development which permits auto service
uses with a conditional use permit,
2. The proposed development will not have an adverse aesthetic,
health, safety, or architecturally related impacts upon
adjoining properties in that restrictions have been placed
upon the property to limit hours of operation and equip-
ment 'whiCh may be used, ,In addition, aesthetic concerns

3, That the proposed deveiopmentis in compliance wi.th the
Zoning Devel6pmeht €ode in that all development standards

City Council Decision:
The City Council hereby approv",s Conditional Use Permit 88""03
and Minor Developfuent Review 88-56 subject to the following
conditions:
1.
Within 30 :days of approva.l: (llThe applicant shall sub,-
mit in writing that all conditi"ons of approval have oeen
read and understood; and (2) The property owner shaTI exe-
cute 'a Notice ,of Restriction onRealProper.ty,

A r",yise(j lands,cape plan. shall be submi tted and approved
by the Direc.tor of PINning Services' within 60 day's' of
approval, Baid plan shall incorpor~te landscaping to
reflect changes indicated on the revised site plan,
including tpe setention of the large mature trees at the
front of the ~soperty.

All hazardous materials used on the premises shall be
disclosed to the County Hazardous Materials Unit and
Material S~fet~ Data Sheets provided to poway Department
of Safety Services,
4.
The applicant shall prepare a plan showing how spilled
oil, s6lvents, and other liquid are handled and controlled
so ~s n6t to create a nuisance .and hazard to the public.
Said plan shall be submi t ted to ,the City for rev iew imme-
diately upon the issuance of the 90nditional use permit
and shall be actively pursued within the first six months
of said permi~ period.
Thefollow'ing environmental mitigation measures shall be
required:
