ingress and egress for roadway purposes in the northeast quarter of Section 21,

of poway Sewage Treatment Plant, located south of poway Road west of City

WHEREAS, the CityC0uncil of the City of. poway desires to sum-
rriarily vacate a cer.tainpublic service easement in accordance with
the procedures provided thereof in Chapter 4, Part' 3" Division 9 of
the Streets and Highwa,ys Code of the State of California, com-
mencing at Section 8330; and
WHEREAS, that certain easement and right~of-way for i.ngress and
egress for. road purposes in the Northeast 'Qu,arter of Sect,ion '21,
Township 14 South, Range 2 West , San Bernardino Meridian .Tas dedi-
cated to the pomerado, County 'Water District on May 28, 19,63 as
Document No. 5322'3, .Series 4, Book 1963 of Official Records of the
San Diego County Recorder; and
WHEREAS, upon incorporation of the City of Poway on December 1,
1980, the City became the successor in interest to said e~sement;
and
WHEREAS, said easement and right-of-way is commonly used as an

access road 'to the City .of poway Sewage Tr,eatmel1"t Plant located at
approximately 1, 500 feet south of the interse'c,tion of Powa'y Road
and Sabre Springs P~ikway.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Poway as follows:
1. This summary vacation is made under ,the provisions of
Chapter 4, Part 3, Division 9 of the Streets and Highways
Code of the State of California.
2. The City Council hereby finds that the he~einbelow
described easement and right-of-way for ingress and egress
for roadway purposes has been "up""rceded, by relocation and
there are no other public facilities locatedwi.thin the
'easemen t (Sec.tion 833 3c) and that there .are no in place
public utility facilities that are in use and would be
affected by ,the vacation (Sec'tion8334.5).
3. The City Council hereby declares the following public ser-
vice easement vacated:
That certain priblic service easement granted to the
Pomeradci County Water District on March 28, 1963 as
Document No. 53223, Series 4, Book 1963 of Offiqial
Records of the San Diego County Recorder, described as
