The Special Meeting of the Poway City Council and Poway Redevelopment Agency was
called to order by Deputy Mayor Higginson at 7:04 p.m.
Councilmembers/Directors Present:

Pledge of Allegiance:
Council led the Pledge of Allegiance.
Public Hearing:
1. Discussion and Direction to Staff Regarding the Process to Fill a Vacancy in the
Office of Mayor and Related Actions and Adoption of Ordinance 690, To Take
Effect Immediately, Repealing Section 224.020 of the Poway Municipal Code
Regarding Vacancies — Special Election to Fill After a Term of Temporary
Appointee (0710-50)
Lisa Foster, City Attorney, reported on the item and advised since the Mayor`s
compensation is an increase in salary, if the nominee waives the pay increase, they
can participate in the voting of that position. Waivers were received from Deputy
Mayor Higginson and Councilmember Boyack.
Motion by Councilmember Cunningham, seconded by Councilmember
Rexford to Adopt Ordinance No. 690, Repealing Ordinance 366, Poway
Municipal Code Section 2.24.020 Vacancies — Special Election to fill after a
term of temporary appointee. Motion carried by the following roll-call vote:

Speakers in support of Merrilee Boyack for the appointment to Mayor: Lynnette
Perkes, Dorina Bauer, Debra Leebolt, Debbie Pola, Terri Sorensen, Toni
Hier,Julie Lawter, Lois Fong-Sakai, Mason Lawler, John Adams, Richard
Slansky, Ctaudia Adams.
Submitted Speaker Slips in support of Don Higginson for the appointment to
Mayor but not wishing to speak: John Fitch, Kevin McNamara, Tom Knothe, Don
Mechling.
Pete Babish preferred the seat of Mayor to be elected not appointed.
Ed Carboneau believed the make-up of Council should include South Poway
residents.
Lori Nixon expressed opposition to appointing Councilmember Boyack as Mayor.
Barbara Lerma and Phil Spea� opposed having a costly special election io fill the
Mayor's seat.
Dee Fleischman expressed concern with the amount of time remaining on
Councilmember Boyack's unexpired term should she be appointed Mayor and
the fact thatsomeone would be appointed to that seat versus elected.
Council discussion.
Motion by Councilmember Cunningham, seconded by Councilmember
Rexford to appoint Deputy Mayor Higginson to fill the Mayor's vacant seat
with a term ending November 2010. Motion carried with Councilmember
Boyack opposed.
Since Councilmember Higginson was appointed Mayor, a vacancy was created.
In response, Linda Troyan, City Clerk, outlined and distributed to Council a
memo outlining an appointment process and schedule for filling the City
Councilmember vacancy.
Motion by Councilmember Rexford, seconded by Councilmember Boyack
to authorize staff to proceed with the City Council vacancy process and
timeline outlined by the City Clerk this evening. Motion carried
unanimously.
The meeting was adjourned at 8:32 p.m.
