make(s)an Irrevocable Offer of Dedication of the hereinafter described real
property to the City of poway for the following pUblic purpose:

'The real property referred to above is situated in the City of Poway, County
of San Diego, State of California, and is more particularly described as follows:

The Grantor hereby further offers to the City of poway the privilege and right
to extend drainage structures and excavation and embankment slopes beyond the
limits of the herein described right-of-way where required for the construction
-= ~ and maintenance of said highwdY. RESERVING unto grantor of the above described
parcel of land, his successors or assigns, the-right to elirnina1:.e such slopes
and/or drainage structures or portions thereof, wh~n in the written opinio~ of
~he, Eng~neer ~f Grantee, the necessity therefore 'is removed by substituting
other p~6~ection, support and/or drainage facility; provided such substitution
is first approved in writing by said Engineer.
The Grantor hereby further offers to Grantee all trees, growths \growing or
that may hereafter grow), and road building materials within said right-of-way,
including the right to take water, together with the right to use the same in
such, IDanf!er and at such :Location as sa.id Grarit.ee il1a.j .deem proper, needful or
neyessary, in the' construction, reconstruction, improvement or maintenance of
said highway.

for any and all damages to Grantor's remaining property contiguous to the
right~of-way hereby conveyed by reason of the location, construction, land-
s~ap~~g or maintenance of said 'highway.

Code of the State of California and may be accepted at, any time by the City
, Council of the City of Poway within which such real property is located at
the time of acceptance.
This Offer of Dedication may be, terminated and 'the right to accept, such offer
abandoned ~n 'the ;saine ~):uier as is' prescribed for the vacation of streets or
highways by Part '3 (cOmrriimcing with Section 8300) of Division 9 of Streets and
HighwaYs,C6de of the State of California. Such termination and abandonment may
be made by the City Council of the City of poway within which such real property
is loca ted.
This Offerof'Dedication shall be irrevocable and shall be binding on the

according to Map thereof no. 4015, filed in the Office of
the County Recorder of San Diego Cou n,t y on November 19, 1958
an'd being- more particularly described as follows:
Beginning at the most Westerly corner of said Lot 20 being a
point on the Northerly right of way of Donart Drive; thence
leaving said right of way North 31006'13" East along the
.5',ommon boundary betw,een, said Lot .2,0 and Lot, .21 of s..~~ i d Map
No. 4016, 140.00 feet to an angle point in the Northwesterly
boundary of said Lot 20; thence South 58053'47" East 60.00
