Res 09-030 RESOLUTION NO. 09-030 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA, DECLARING A LEVEL 2 WATER CONDITION, CONSISTENT WITH CHAPTER 8.94 OF THE POWAY MUNICIPAL CODE, ESTABLISHING MANDATORY WATER CONSERVATION MEASURES WHEREAS, the City of Poway imports nearly 100% of its water supply from Northern California and the Colorado River via contractual arrangements with the San Diego County Water Authority and the Metropolitan Water District of Southern California; and WHEREAS, historically dry conditions throughout California and along the Colorado River Basin are limiting the amount of water available; and WHEREAS, a federal court environmental ruling in August 2007 imposes significant restrictions on the amount of water allowed to be pumped from Northern California; and WHEREAS, on April 14, 2009, the Metropolitan Water District of Southern California announced it would reduce the amount of water supplied to the San Diego County Water Authority by 13% beginning July 1, 2009; and WHEREAS, the San Diego County Water Authority announced April 23, 2009, that it would reduce the amount of water supplied to its member agencies, including the City of Poway, by 8% beginning July 1, 2009. WHEREAS, the City of Poway must reduce total water demand by at least 8% or face severe financial penalties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway that: 1) A Level 2 water condition is hereby declared, as set forth in Poway Municipal Code Chapter 8.94 - Water Conservation Plan, effective July 1, 2009; and 2) Mandatory water conservation measures are hereby established, as identified in Poway Municipal Code 998.94.040 and 894.050, effective July 1, 2009, with the following changes: a. Ornamental fountains that recirculate water may be used no more than six hours per day. When reductions in water deliveries to Poway reach 15%, the use of ornamental fountains shall be prohibited unless the fountain uses reclaimed water. b. Covers will not be required on single-family residential pools and spas until reductions in water deliveries to Poway reach 15%.
