WHEREAS,

owners of the FEE SIMPLE ESTATE in and to the land in the City of
Poway, State of Calif.or.nia, described in Exhibit "A" and shown on plat
map attached hereto ("The Subject Land"); 'which estate is or ma y :b e
subject to real estate, :taxes, assessments, conditions, restr.ictions and

(A) A perpetual easement for OPEN SPACE purposes over, upon,
across, ~nd ~naer the Subject Land, and no building, structure
, , or other thing whatsoever shall be constructed, erected,
placed or ma:Lrftained on the Subject Land except as exists.
(8) The perpetual right, but not the obligation to enter upon the
S.ubject Land and remove any buildings, structures or other
things whatsoever constructed, erected, placed or maintained
on the Subject Land contrary. to any term, c() v.ena n t or
,condition of tliis easement and to do any wor,k ne.ce ssary to
.elimi'nate the. effects of any excav"ation or placement of sand,

as follows:
(Ii} .That,he shall not erect, construct', ,place or .maintain, or permit the
er:ec-t16n, construction, placement o.r, -z:naintenance of any building or
structure. or other thing wh.a tsoever on the 5ubj eet Land other than
such buildings, structures a-nd ot:her things as may be permitted
pursuant to the zoning' ordinance of the City of Poway,
(B) That he shall not use the Subj!,ct Land for any purpose except as
.OPEN SPACE purposes.
(C) That he shall not .excavate or grade or permit any excavating or
grading to be done, or place or allow to. be placed any sand, soil,
rock, gravel or other material. whatsoever on the Subject Land without
the written permission of the City or its successors or assigns:
Provided, howevert that G~antor -may excavate" grade or pla~e sand,
soil, rock, gravel or other material on the Subject Land as may be
permitted by special use permit issued pursuant to the zoning
ordinance of the City of Poway.
(D) That ~he terms, covenants and conditions set forth herein may be
specifically enforced' or enjoined by proceedings in the Superior
Court of the State of California.
The grant of this easement and its acceptance by the City of poway sh!lll not
autho:t;ize the public, or any. ~ember-s, -thereof ,to, use or enter upon all 'or any
portion of the Subject Lanu, it being understood that the purpose of this
easement is solely to restrict the uses to which the Subject Land may be put.
This easement ..shall bind the Grantor and his successors and assigns..
