proper.ty described. in Exhibit 'A which is attached hereto and made a part hereof

("PROPERTY" hereinafter). In consideration of the approval of Minor Conditional
UsepennIt 88-03 by the City of l'oway ("CITY" hereinafter), CWNER hereby cove-
nants ,ana agrees for the benefit of the CITY, to abide by conditions of the
attached resolution (Exhibit B).
This Covenant shall run with the land and be binding upon and inure to the
benef i t of the future owners" encumbrances, successors, heirs, personal
representatives, transferees and assigns of the respective parties.
CWNER agrees that OWNER's duties and obligations under this Covenant are a
lien upon the Property. Upon notice and opportunity to respond, the CITY may
add to the tax bill of oWNER any past due financial obligation owing to CITY BY
Wciyof this Covenant.
If either party is required to incur costs to enforce the provisions of this
Covenant, the prevailJQg p<lrty shall be entitled to full reimbursement of all
costs, including reasonable ,attorneys' fees, from the other party. The CITY may
assign to persons irnpacted'by the performance of this Covenant the right to
enforce this Covenant against oWNER.

APPROVING MINOR CONDITIONAL USE PERMIT 88-03
ASSESSOR'S PARCEL NUMBER 273-9ll-l8
WHEREAS, Minor Conditional Use Permit 88-03, submitted by
Comstock - Floodberg, Architects, applicants, request approval
to construct a 500 'squa're foot pool house for a single family
home at l29l7 Lomas Verdes' Dr i ve, in the RR-C (Rural
Residential C) zone; and

-, WHEREAS, on March 1988, the City Council held a duly
advertised public hearing to solicit commen.ts from the public,
bO,th pro ano con, relative to this application.
NOW, THEREFORE, the City Council does hereby resolve as
follows:
Section l: Findings:
l. That the location, size, design, and operating charac-
teristics of the proposed use will be compatible with
and will not adversely affect or be materially detri-
mental to adjacent uses, residences, buildings, struc-
tures, or natural resources, in that the use is
accessory to and compatible with single family resi-
dential development.
2 . That the harmony, in scale, blllk" coverage, and dens i ty
is consistent with adjacent uses, in that ~s an
accessory structure, the guest house is small in pro-
portion .to theexi sting home. The proposed architec-
tural design and fi'nish materials match the house.
3. That there are available public facilities, services,
and utilitie~.
4. That there will, not. be a 'harmful e:ffec't upon (jesirable
n'eigtlborhood characteristi_cs, in that the subject lot
is very large and can accommoda.te the added 'square
footage.
S. That the generation of traffic will not adversely
impact the surrounding streets and/or the City's
Circulation Element because the use rema'ins single-
family only.
6. That the site is suitable for the t'ype and intensity
of use or development which is proposed.

7. That there will not be significant harmful effects upon
environmental quality and natural resources.
8. That there are no other relevant negative impacts o~ the
proposed use that cannot be mitigated.
9. That the impacts proposed location, size, design, and
operating characteristics of the proposed use and the con-
ditions under which it would be operated or maintained
will not be detrimental to the public healtfl, safety or_,
welfare, or materially injurious to properties or improve-
ments in the vicinity nor be contrary to the adopted
General plan in that public facilitie~ including proposed
sewer and water are available to serve the project and the
use is consistent with the General Plan.
10. That the guest house is in compliance with each of the
applicable provisions of Ordinance l7.48 (conditional use
permit regulations).
Section 2: Environmental Findings:
[This project is Categorically Exempt Class 3 - a small struc-
ture, under the provisions of CEQA.
Section 3: City Council Decision:

88-03 subject to the following condit'ions:
l. Within 30 days bf approval: Il) The applicant shall submit
in writing that all conditions of approval have been read
and understood; and (2) the property owner shall execute a
