Grantor, by this instrument, also irrevocably and unconditionally
grants to Grantee ahd ~:F. Poway, Ltd., a California limited
partnership ("C. F. poway"), its agents, contractors, and
subcontr,acto,rs the Light to enter upon ,the Property and any
remaining property or' Grantor located cont",iguous or adjacent
thereto to const'ruct, ma'intain, and repair Pomerado Road, and to
perform construction, removal, excava~ion, refill, or any other
activities related to the construction of Pomerado Road,
including, witho,ut lim'itation, the reTated activities described
hereinabove, on behalf of Gr,antee and/or pur"suant to instructions
or directions of Grantee pursuant to this Offer of Dedication.
Grantor, her heirs"executors, administrators, successors, and
assigns in no event ,sha i.lbe responsible fo rthe construction;
maintenance, repair, replacement, and/or reaLignment of the
Property, including, without limitation, Pomerado Road and/or the
facilities related thereto as described h~reinabove.
Grantor,for herself, her heirs, executors, administrators,
successors, and assighsi, hereby wa'ives any claim, against Grantee
and/or against C. F. ,Pow,ay, its agents, contractors, and/or
subcontractors, for'anyand all damages to ,Grantor's remaining

This Offer of Dedication is made pursuant to Section 7050 of the

accept such offer abandoned in the same manner as is prescribed
for the vacation of streets or highways by Part 3 (commencing
with Sec,tion 830()) of Division 9 of Streets and Highways Code of
