A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING, MINOR CONDITIONAL USE PERMIT 89-04
ASSESSOR'S PARCEL NUMBER 275-700-51
WHEREAS, Minor .Conditional Use Permit 89-04, submitted by Gary and Valerie
Sabin, applicants, request approval to construct a.60' x 120' lighted tennis
court at 16289 Oak Creek Trail in the the RR-C zone; and
WHEREAS, on January 30, 1990, the City Council held a hearing on the above-
referenced item.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Findings:
The City Council finds that 'this project is categorically exempt (Class 3)
from the California 'Environmental Quality Act {CEQA).
Section 2: Fi ndi'ngs:
1. That the proposed development is in conformance. wHh the poway Genera I
Plan in that .the prooposed recreational court is an accessory use for a
single family residence in a rural residential zone and the General
Plan designat,ion isRR-C.
2. That the proposed development will not have an adverse aesthetic,
health, safety, or architecturally related impact upon adjoining pro-
perties, in that the grading design and landscape insta.llation,
construction~ethod, and court materials, will be compatible with and'
screened from surrounding properties.
3. That the proposed development is in compliance with th~ Zoning
Ordinance, in that i~ ~ompiies with the setbacks, fence he~ght limit,
lighting standards and all other property development standards of the
RR-C'ione. .
4. That the proposed .developme'nt encourages the orderly and harmonious
appearance of structures and property with';" n the Ci ty, in that all '
surrounding prope'rties are under the ,same zoning'design'ation as the
subject lot and are to be devel'oped as single-family residences.
Section 3: City Council Decision:
The City Council hereby approves Minor Conditional Use Permit 89-04 subject
to the following conditions:
Within 30 days of approval: (1) The applicantsha.1l submit in writing that
all conditions of approval have been read and understood; and (2) the pro-
perty owner shall execute a Covenant on Real Property.
