CONDITIONS RE: GRANT OF ElISEMEN!' 'IO J\CXXMoIQDATE muESTRIAN AND
PEDESTRIAN TRAILS ON CEME:l'ERY PROPERTY
l. The City of poway is to pay all costs for the construction of said easement.
2. The panerado Cemetery District will pay 50 percent of the costs involVed
in the, erection of the fence required; as recorded in the Minutes of the
Special Board Meeting held January 28, 1985.
3. The City of poway will respect the rights of the panerado cemetery District
to relocate the easement should it prove to be rcore advantageous regarding
future use, development, or resale of cemetery property. This refers to the
portion of the proposed trail located in APN 321-191-04 only. The portion
in APN 321-191-06 will permanently remain easement.
4. The City of poway will maintain said trail in accordance with any and all
City, County, and State regulations as affecting the installation, main-
tenance and control of said easement.
5. The City of poway shall at all times canply with all statutes of the State of
California and ordinances of the County of San Diego as such law applies to
said easement.
