John G. Allen and Dorothy C. AIle", as trustees of the Allen
Family Trust #95-6643650, da ted June 14, 1978 (hereinafter
"GRANTOR" ) hereby grant to CITY OF POWAY (hereinafter "GRANTEE")
its successors, or assigns, a 20 foot wide easement for equestrian/
pedestrian trail use by the public and a 100 foot by 100 foct
staging area for use by the public, upon, along and across that
real property described herein below.
The City of poway will improve, maintain, or cause to be
maintained the equestrian/pedestrian trail system. All improvements
and maintenance shall be at no expense to the Grantor.
This easement shall be relocated upon the further written agreement
of Grantor and Grantee in the event that relocation can be
accomplished to the mutual satisfaction of Grantor and Grantee.
'='hc land t,urdened by this easement is situated in the CI'l'Y OF
POWAY, County of San Diego, State of California, and is more
particularly described as follows:

strip of land lying within Lot 1 in Section 3, Township 14 South,
Range 1 West, San Bernardino Meridian, in the County of San
Diego, State of California, according to United States Government
Survey, the Southerly line of said 20 foot strip more particularly
described as follows:
Commencing at the Southeast corner of said Lot 1; thence Northerly
along the East line of said Lot 1 North 0039'49" \Vest 338.36 feet
to the Point of Beginning; thence leaving said East line North
3r27'26" West 103.10 feet; thence North 71002'52" l'lest 355.79

Township 14 South, Range 1 \'/est, San Bernardino Meridian, in the
County of San Diego, State of California, according to United
States Government Survey, more particularly described as follows:
The West line of said 100 foot by 100 foot area is contiguous
with the East right-of-way line of California State Highway
Xl-SD-198-M (State Highway No. 67) and the North line of said
100 foot by 100 foot area is contiguous with the South line
of said Parcel 1 described above.
Said easement will become effected upon appropriate posting
and improvements to the satisfaction of the Grantor.
Said easement will expire and become null and void at such time
as an alternate right-of-way license is acquired by the Grantee.
Said easement will become null and void if the condition of the
entry apron is not maintained by the Grantee to the satisfaction
of the Grantor.
