A RESOLUTION OF THE CITY_COUNCIL_OR-THE C-ITY OF-POWAY;
- `—CALIFORNIA, VACATING A PORTION OF AUBREY STREET,
WEST OF GAELYN COURT
VACATION NO. VAC 84-03
(STANDARD PACIFIC OF SAN DIEGO)
WHEREAS, there has been requested the vacation of the herein-
after described portion of Aubrey Street, and
WHEREAS, on September 18, 1984, the City Council of the City
of Poway declared its intention to vacate the said street easement
by its passage of City Council Resolution No. 84-080, and
WHEREAS, on October 16, 1984, a duly advertised and posted
public hearing was held on the vacation request,
NOW THEREFORE; BE IT RESOLVED, by the City Council of the
City_,of_Poway—as follows:. __
1. City Council hereby finds that:
a. The proposed street vacation is categorically
exempt from the requirements for an Environ-
mental Impact Report or Negative Declaration,
pursuant to Class 15300.4c of the State
Guidelines.
b. There were no written or oral objections or
protest to the said vacation.
c. A storm drain easement and a utility easement,
as hereinafter described, shall be reserved
from the street vacation to protect existing
drainage and utility facilities, pursuant to
Section 8340'of the State Streets and Highways
Code.
d. The street easement to be vacated has no other
present or prospective public use., and cannot
be utilized for any public bikeway or trail
systems.
2. Pursuant to Chapters 3 and 5 of Part 3 of Division 9 of
the State Streets and Highways Code, the following -
described portion of Aubrey Street is hereby vacated
and abandoned:

All that portion of Aubrey Street within Poway
Mesa No. 2 according to Map thereof No. 7244 in
the City of Poway, County of San Diego, State
of California, filed in the Office of the County
Recorder of San Diego County, March 30, 1972
described as follows:
Beginning at the Southwesterly Corner of Lot 159
of said map being also a point on a 1458.00 foot.
Radius Curve the Center of which bears North
41°32'52" East (Record North.41°33'09" East);
thence Southeasterly along the arc of said curve
and-al-ong the Southwesterly —line of said_Lot_159._
thru a Central Angle of 1°54'4211,48.65 feet;
thence North 70°55'32" West, 39.30 feet to the
Westerly line of said map; thence along said
Westerly line North 0°37'05" East (Record North
0°37'24" East) 18.81 feet to the POINT OF
BEGINNING.
RESERVING THEREFROM the following easements and
rights:
a) An easement for storm drain purposes in and
to the West 15.00 feet of the above described
portion of Aubrey Street.
b) An easement for public utility purposes for
the construction, maintenance, operation,
replacement, removal, renewal or enlargement
of lines of pipe, conduits, cable, wires,
poles, and other equipment and fixtures for
the operation of telegraphic and telephone
lines, in and to the entire above described
portion of Aubrey Street.
3. That the City Clerk of the City of Poway. is hereby
directed to cause a certified copy of this resolution
to be recorded in the Office of the County Recorder..
PASSED AND ADOPTED by the City Council of the City of Poway,
California, at a regular meeting thereof this 16th day of October,
1984.
