In the event of any dispute involving this Agreement, whether or not liti-

rel ief, is brought to enforce or interpret the provisions or performance of
this easement, the prev.ailing party shall be entitled to an award of an attor-

LEGAL DESCRIPTION
EASEMENT FOR .WATERLINE AND APPURTENANCES
That portion of Lot 44 of City of poway Tract 85-04, in the City of Poway,
County of San Diego, State of California according to Map thereof No. 12044,
recorded. April 18, 1988 in the Office of the Recorder of San Diego County, more
particularly described as follows:
A 10.00-foot wide strip of land lying within said Lot 44, the
Northerly line of which is described as follows:
Beginning at the most Northwesterly corner of said Lot 44, said
point be.ing also the .most Southwesterly corner of Lot 43 of said
Map No. 12044 and being on the arc of a 48.00-foot radius curve
concave Northwesterly; thence along the Northerly property line of
said Lot 44, South, 85~42'51" East, 174.62 feet; thence continuing
along said property line North 79032'50" East, 50.00 feet to a
terminus.
The Southerly sideline of the above strip of land shall be pro-
longed or shortened so as to terminate Westerly on the arc of said
