by the signature of the Director of Engineering Services on an approved plan.

described easement whi,ch exists at the time this document is executed without
obtaining the prior written consent of the GRANTEE.
In the event of any di?pute. involving this Agreement, whether or not I iti-
gation is conmenced, or H any arbitration proceeding, administrative pro-
ceeding or litigation in law or in equity, includ.ing an action for declaratory
relief, ;s brought to enforce or interpret the provisions or performance of
this easement, the prevailing party shan be entitled to an award of all attor-
ney's fees and the costs oJ .the proceeding, which shall be determined by the
court or the presiding offi.cer having authority to make this determination.
GRANTOR expressly warrants and represents that GRANTOR has the power to
grant this easement in accordance with its terms.

A 10.00-foot wide, strip of land lying within said Lot 43, the
Southerly line of which is described as follows:
8eginning at the most Southwesterly corner of said ,Lot 43, said
point being al.so the m()st NortHwesterly :corner of Lot 44 of said
