OF RIGHT-OF-WAY PRIVILEGES AND RIGHTS LOCATED WITHIN
PARCEL 2 OF CITY OF POWA Y PARCEL 88-0'4, MAP THEREOF 15255

WHEREAS, the City Council ,of the City of poway desi res to surrmari ly vacate
t'ertatn, publ i c right-of-way privil eges and rights in ,accordance with the proce-
'dirre's prOIii'deo in Chapter 4, Part 3, Division 9 of the Streets and Highways Code
of the State of California, conmencing at Section 8330; and
WHEREAS, the privilege and right to extend drai,nage structures and excava-
tion and embankment slopes ~eyond the limits of Poway ~oad (per Road Survey 944)
where, requ,ired forconstruct,ion and maintenance with,in the attached legal
description titled "Exhibit A" were dedicated to the County of San Diego per
deed recorded October 24, 1944 in Book 1765, Page 2g7, Official Records in the
Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
1. This sunmary va,cati~ri is made under the provisions of Chapter 4, Part
3, Div.ision 9 of the',Streets and Highways Code of the State-of
Cal ifornia.
2. The City Council hereby finds that the herein c,=scribed publ ic right-
of~way privileg~s and rights have becoMe, obsolete and are no longer
necessary.
3. The City Council hereby declares that the fo,llowing described right-of-
way privileges and rights are hereby vacated:
See attached: legal description titled "Exhibit A."
4. The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy of this resolution to be recorded in the office of the
Re c.() (;der _of San DJe90 Co,unty in a,c.cordancewith the provisions of
Sectibn ~336 of' the Streets and 'Highways Code.
PASSED, ADOPTED, AND APPROVED, by the City Council of the City of Poway,
California, at a regular meeting this 11th day 1990.
