WHEREAS, the City Council of the City of Poway desires to summarily vacate
~ertain public servi~e ~!sements in accordance with {he procedures provided in
Chapter 4, Part 3, D;v;s,;;on ,9 of the Streets and Highways Code of the State of
California" commencing at Section 8330; and
'WHEREAS, joad and utility easements within t~e attached legal description
titled "Exhibit A" weredei:ticated to the City of poway per document recorded
Sep,tember 14, 1979 as Fi le No. 79~384813 and per map 10523 recorded November 24,
1'982 as File' No. 82-364197 \ n the Offi ce of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City CounCil of the City of Poway as
'fo 11 oW5:
1. This sunmary vacatIon is made undefr the provisions of Chapter 4, Part
3; Divtsion 9 of the Streets and Highways Code of the State of
Cal ifornia.
2. The City Council hereby finds that the herein described public service
easements have been superseded by relocatTonand there are no public
facilities located within the easements.
3. The City Counc{l hereby declares that the following described road and
utility easements are hereby vacated;
See attached l~gal descrIption titled "Exhibit A."
4. The City Clerk of the City of Poway is hereby directed to cause a cer-
tified copy ,of thIs resolution to be recorded In the office of the
Reto-rder o'fSifn Dfego County in accordance with 'the provisions of
Section 8336 of the Streets and Hi~hways Code.
PASSED, ADOPTED, AND APPROVED, by'the City Council of the City of Poway,
