WHEREAS, Thomas A. Li~ouri and Susan K. Ligouri are the owners of real pro-
perty descri bed in Exhfbit A whi ch is attacfled hereto and made a part hereof 'and
which is common ly known as Assessor's Parce 1 Number 277 -U21-1.)2, 04, and
277-U11-U4 .
WHEREAS, in li,eu of the immediate installation a'nd dedication of underground
uti 1 i ty improvements on the property described above" it is the des ire and
intention of the owner to impose upon the property, described above these cove-
nants, for said future improvements for the benefit of the City of Poway,
Cal iforni a.
The owner hereby declares that' all the property described above is held and
shall be held, conveyed, hypothecated or encumbered, leased, rented, used,
occupied and improved, subject to the following cov,enants, which shall run with
the land and shan be binding on all parties having or acquiring any right,
title or interest in the descHbed land or any part thereof .
No protest shall be made ,by the owner to any proceedings for the installation or
acquisition of underground utility improvements on the property described above
under any speci al assessment proceedi ngs, whether conducted pursuant to the
Inlprov,ement Act of 1911 or the Munic,ipal 1I11provemeilt Act of 1913, or any other
a,ppli.cable State or lota,l Javr, and whether processEed by th'e City of Poway Dr any
o.l'her ,governmenta 1 enti'ty havi ng juri sdicti on in the matter and for the purposes
of determ,i nfng property own"er support for same.
