Whereas Richard Jiles and Beverly Illes, husband andVliife as joint tenants, PROPERTY
OWNERS ("OWNER" hereinafter), are the owners of real property commonly known as 17975 Cielo
Court ("PROPERTY" hereinafter), and more fully described a's:
Lot 9 of City of Poway Tract No, 81-01 Unit No.2, in the City of Poway, County of San
Diego, St<)te of California, according to map thereof No, 11844, filed in the Office of the
County Recorder of San Diego County, June 24,1987,
In consideration of the approval by the City of poway ("CITY" hereinafter) of a Building Permit
for the construction of a 316-square,foot, detached guest house. OWNER hereby agrees that no
portion of the guest house shall ever be rented or leased as. a separate unit, no complete kitchen
facilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event of litigation to enforce the provisions of this Covenant, the prevailing'party shall -,--
be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other
party,
