inci,dents thereto for a public street upon, over and across that certain real property
in the City of Poway, County of San Diego, State of California, described as follows:

The GRANTOR hereby further grants to the Ci ty of Powaythepri vi lege 'and right to
extend drainage struct~res and excavation and embankment slopes beyond the limits of
the herei n d.escri bed ri ght-of-way where',regui red for the cons tructi on, and ma i I1tenance
of said City Street. RESERVjNG unto GRANTOR of the above described parcel of land,
his successors or assigns, the right to eliminate such. slopes anelloI' drainage structures
or porti ons thereof, wneh i:.nthe wri tten opini on of the City. Eng i neer of GRANTEE, the .
necess i ty therefore is removed by subsfi tut 1 ng oth~r pr.otection, support andlor
drainage faci 1 ity, provided such s.ubstitution isfi rst approved in writi ng by sai d
Engineer.
The GRANTOR hereby further gn!lnts,to GRANTEE all trees., growths (growi ng or that may
hereafter grow), and road building materials withi.n said right-of-way, includ.ing the
right to take water, together !'lith the right to use the same in such manner. and at
such locations as saidGRANTE[.may deem proper, needful or iiecessary, in the construc,-
tion, reconstruction, improvement or maintenance ofs'aid highway.
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives any claim
for any and all damages to GRANTOR's rema i ni ng property conti guous to the .ri ght-of -way
hereby conveyed by reason. of the location, construction, 1 andscapi ng. or maintenance of
said highway.
