GRANT OF LICENSE AGREEMENT
PREAMBLE
This Agreement made this 28th day of December, 1982, by and between
J.L. Roberts, hereinafter referred to as nLlcensor,n and the City
of poway, hereinafter referred to as "Licensee."
RECITALS
WHEREAS, Licensor is the owner of certain real property commonly known
as Green Valley Ridge, in the City of poway, County of. San Diego, State
of California, hereinafter referred to as the "Servient Tenement," and
described as follows:
portions of the South one-half of the Northwest one-quarter and
portions of the Northwest one-quarter of the Southwest one-quarter
of Section 6, Township 14 South, Range 1 West, San Bernardino Base
Meridian and the Southeast one-quarter of Section 1, Township 14
South, Range. 2 West, San Bernardino Base Meridian: and may refer to
property as setforth as Exhibit "An attached and incorporated
herein: and
WHEREAS, Licensee is the City of Poway, California, and
WHEREAS, Licensee desires to acquire certain rights in the Servient
Tenement:
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
GRANT OF LICENSE
1. For valuable consideration, including but not limited to approval of
Licensors development project (known as Green Valley Ridge), Licensor
hereby grants to Licensee a license hereinafter described.

DESCRIPTION OF LICENSE
2. The license granted herein is for use as an unobstructed horseback
riding, hiking, and jogging trail.
LOCATION
3. The License granted herein is located as follows:
A ten ( 10) foot strip that runs inside and along the entire
northern boundary and four-hundred and forty-six (446) feet
inside, along the eastern border of the Servient Tenement (Green
Valley Ridge Development).
USE BY CITY OF POWAY
4. The license granted herein includes the following use of the Servient
Tenement: horseback riding, hiking, and jogging.
EXCLUSIVENESS OF LICENSE
5. The license granted herein is not exclusive and shall inure to the
general public.
SECONDARY LICENSE
6. The license granted herein includes incidental rights of maintenance,
repair, and replacement, described as follows:
Fence installation, painting and repair, tree and brush trimming
and removal, installation of water bars, and minor grading to
repair trail surface.
ENTIRE AGREEMENT
7. This instrument contains the entire agreement between the parties
relating to the rights herein granted and the obligations herein
assumed. Any oral representations or modifications concering this
instrument shall be of no force and effect excepting a subsequent
modification in writing, signed by the party to be charged.
ATTORNEY'S FEES
9. In the event of any controversy, claim, or dispute relating to this
instrument or the breach thereof, the prevailing party shall be
entitled to recover from the losing party reasonable expenses,
attorney's fees, and costs.
BINDING EFFECT
10. This instrument shall bind and inure to the benefit of the respective
heirs, personal representatives, successors, and assigns of the
parties hereto.
