GRANT OF OPEN SPACE EASEMENT
WHEREAS ,
1. The undersigned Grantors warrant that they are the owners .of the FEE SIMPLE
ESTATE in and to the land in the City of Poway, State of California, described in
Exhibi t "A" and shown on plat map attached hereto '("Tlj8 Subject Land") i which estate
is or may be subject to real estate taxes t assessmen't"s't conditions, restrictions and
easements all as the same may be of recordj and
2. It is the desire of the, Grantors and the City of poway, a political $ubdi vision
of the State of California (hereinafter referred to as "CITY") that the Subject
Land remain OPEN SPACE.
NOW THEREFORE,
1. The GRANTORS hereby. grant to the City:
(ll.) A perpetual easement-for OPEN SPACE purposes overJ upon, across and under
the Subject Land, arid no dwelling, building~ structure or other thing
whatsoever shall be constructed, erected, p~aced or maintained on the
Subject Land except as hereinafter provided.
(B) The perpetual right, but not the obligation to: enter upon the Subject
Land and remove anY' Quildings, structures or other things whatsoever
con?tr~ct~d, ejected, placed or maintained on the Subject Land contrary
to any term, covemant, ,or condition of,this easement and to do any work
necessa,ry' tq, 'elimInate t.he' effects of any exc"avation or' placement of

Subject Land contrary to any term, covenant or conditions of this easement.
