RESOLUTION NO. 09 - 053
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY,
CALIFORNIA, PROCLAIMING THE TERMINATION OF THE LOCAL
EMERGENCY THAT WAS DECLARED ON OCTOBER 25, 2007, AS A RESULT
OF THE WITCH CREEK FIRE
WHEREAS, on October 22, 2007 the City Manager of the City of Poway,
acting as the Director of Emergency Services, proclaimed a Local Emergnecy,
finding that conditions of extreme peril to the safety of persons and property had
arisen within said City as a result of a wildfire known as the "Witch Creek Fire"
entering the boundaries of the City; and
WHEREAS, the City Council ratified the Local Emergency proclaimed by
the City Manager on October 25, 2007, by passing Resolution No. 07-079,
entitled, "A Resolution of the City Council of the City of Poway, California, Finding
and Declaring the Existence of An Emergency Within the City Due to Wildland
Fires, and Suspending Notice and Bidding Requirements in Connection with
Repairs Required Thereby"; and
WHEREAS, the conditions of extreme peril caused by the Witch Creek
Fire are now deemed to be within the control of the normal protective services,
personnel, equipment, and facilities of and within the City of Poway; and the City
has completed all expenditures and repairs that were required as a result of the
wildfire.
WHEREAS, the City of Poway expended $2,605,880.76 for necessary
repairs and erosion control measures under the emergency authorization.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. Appropriate emergency repairs were authorized by the City Manager in
accordance with Public Contract Code.
2. The required work to restore public facilities and provide for erosion
control necessitating the suspension of notice and bidding requirements
for the city of Poway, post Witch Creek Fire, have been completed.
3. Resolution No. 07-079 is hereby rescinded.

Poway at a regular meeting this 21st day of July, 2009.
