A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
AMENDING THE LAND USE ELEMENT OF
THE GENERAL PLAN OF THE CITY OF POWAY
GENERAL PLAN AMENDMENT (09-01)
WHEREAS, the City Council of the City of Poway recognizes that the need may
arise to amend the City's General Plan; and
WHEREAS, Section 65350, et seq., of the California Government Code
describes the procedures for amending General Plans; and
WHEREAS, Section 17.46.020B of the Poway Municipal Code (Zoning
Ordinance) provides that a change in the boundaries of any zone or a change in
regulations may be initiated by Resolution of the City Council; and
WHEREAS, on June 2, 2009, the City of Poway held a properly noticed public
hearing in accordance with the California Government Code; and
WHEREAS, the redesignation implements the requirements of the Poway Habitat
Conservation Plan, and its companion Implementing Agreement, by requiring the
redesignation of the land over which a Biological Conservation Easement has been
recorded to Open Space - Resource Management to ensure the permanence of the
mitigation land or undeveloped land in open space and as native habitat, and
WHEREAS, General Plan Amendment 09-01 consists of the redesignation 88
parcels, or portions thereof, that have been acquired for, or dedicated as, biological
mitigation land or the preservation of open space from either Rural Residential-A
(RR-A), Rural Residential-B (RR-B), Rural Residential-C (RR-C), or Planned
Community (PC) to Open Space-Resource Management (OS-RM), and are located
throughout the City, and identified as APNs:

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
Section 1: The City Council has considered the Environmental Initial Study (EIS) and
Negative Declaration (ND), for General Plan Amendment 09-01, Zone Change 09-01
and Specific Plan Amendment 84-01 F(4) and public comments received on the EIS and
ND. The subject EIS and ND documentation are fully incorporated herein by this
reference. The City Council finds, on the basis of the whole record before it, that there
is no substantial evidence the project will have a significant impact on the environment.
No additional environmental review is required for this project.
Section 2: The City Council hereby approves General Plan Amendment 09-01 to
change the zoning and land use of 88 parcels, or portions thereof, located throughout
the City and as shown in the attached Exhibit A, identified by the APNs noted above,
from either RR-A, RR-B, RR-C, or PC to OS-RM.
PASSED, ADOPTED and APPROVED by the City Council of the City of Poway,
State of California, this 21st day of July 2009.
