of the hereinafter described real property, and for a valuable consid-
eration, hereby make(s) an Irrevocable Offer of Dedication of the here-
inafter described real property for the following public purposes:
The real property referred to above is situated in the incorporated area
of the City of Poway, County of San Diego, State of California, and is
more particularly described as follows:
A strip of land 56.00 feet in width lying within a portion of the
Northeast Quarter of the Northwest Quarter of Section 7, Township
14 South, Range 1 West, San Bernardino Base and Meridian in the
County of San Diego, California and more particularly described
as follows:
The Northerly 56.00 feet of that portion of said Northwest
QuarteT of Section 7 as described in Document No. 75-279432
recorded October 10, 1975 in the office of the Recorder of
said County.
Together with all that land lying Northerly, Northwesterly and
Westerly of the arc of a 20.00 foot radius curve tangent to the
Southerly line of said Northerly 56.00 feet and the Easterly line
of R.S. 1488
This Offer of Dedication is made pursuant to Section 7050 of The Govern-
ment code of the State of California and may be accepted at any time by
the city council of the city within which such real property is located
at the time of acceptance or, if located in the unincorporated territory,
by the Board of Supervisors of the County of San Diego.
This Offer of Dedication may be terminated and the right to accept such
offer abandoned in the same manner as is prescribed for the vacation of
streets or highways by Part 3 of Division 9 or Chapter 2 of Division 2
of Streets and Highways Code of the State of California, whichever is

applicable. Such termination and abandonment may be made by the city
council of the city within which such real property is located, or if
located in the unincorporated territory, by the Board of Supervisors of
the County of San Diego.
The Grantor hereby further grants the City of poway the privilege and
right to extend drainage structures and excavation and embankment slopes
beyond the limits of the herein described right-of-way where required
for the construction and maintenance of said City Highway. RESERVING
unto grantor of the above described parcel of land, his successors or
assigns, the right to eliminate such slopes and/or drainage structures
or portions thereof, when in the written opinion of the City'and/or
District Engineer of Grantee the necessity therefore is removed by sub-
stituting other protection, support and/or drainage facility, provided
such substitution is first approved in writing by said Engineer(s).
The Grantor hereby further grants to Grantee all trees, growths (growing
or that may hereafter grow), and road building material within said
right-of-way, including the right to take water, together with the right
to use the same in such manner and at such locations as said Grantee
may deem proper, needful or necessary, in the construction, reconstruction,
improvement or maintenance of said highway.
The Grantor, for himself, his successors and assigns, hereby waives any
claim for any and all damages to Grantor's remaining property continguous
to the right-of-way hereby conveyed by reason of the location, con-
struction, landscaping or maintenance of said highway.
