California, hereinafter called G'RANTEE, the right of way and incidents thereto for a public highway upon, over and
across that certain real property in the City of Poway ,State of California, described as follows:
Parcel No. 81-0671-A (6-23-81) (LT:LT:ab)
That portion of Lot 3 of Section 31, Township 13 South, Range 1 West,
San Bernardino Meridian, in the County of San Diego, State of Cali-
fornia, according to United States Government Survey, approved
November 19,1880, described in the following parcel:
Allthat portion of Parcel 17 of Record of Survey Map No. 3835 filed in
the Office of the County Recorder of said County described as follows:
Commencing at the Northwesterly corner of said Parcel 17; thence
North 88029'05" East along the Northerly line of said Parcel 17,330.39
feet to an angle point in the boundary of said Parcel 17, being the
TRUE POINT OF BEGINNING; being also the beginning of a non-tangent 331.40
foot radius curve concave Southeasterly, a radial line of said curve
bears North 59037'49" \vest to said point; thence Southwesterly along the
arc of said curve curve through a central angle of 04016'23" a distance
of 24.72 feet to a point of cusp being the beginning of a tangent 20,00
foot radius curve concave Southwesterly; thence Northwesterly along the
arc of said radius curve through a central angle of 103021 '12" a distance
of 36.08 feet to the beginning of a tangent compound 170.00 foot radius
curve concave Southerly; thence Westerly along the arc of said curve
through a central angle of 12012'51" a distance of 35.24 feet to a point
of cusp being a point of tangency with the Northerly line of said Parcel 17;

distance of 67.33 feet to the TRUE POINT OF BEGINNING.

written opinion of the City and/or District Engineer of Grantee, the necessity therefore is removed by substituting
other protection, support and/or drainage facility, provided such substitution is first approved in writing by said
Engineer(s),
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road building
.materials within said right'of-way, including the right to take water, together 'Nith the right to use the same in such
manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction, reconstruction,
improvement or maintenance of said highway,
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor's re-
maining property contiguous to the right-of-way hereby conveyed by reason of the location, construction, landscaping
or maintenance of said highway,
