COVENANT REGARDING REAL PROPERTY
THIS COVENANT made the 10th day of January, 1989., WITNESSETH: That Richard
L. and Rebecca Field, are -the owner(s) Dfrea1 prOperty described in Extiibit A
which is attached hereto and made a part hereof and whiCh is commonTy known as
Assessor' 5 Parcel Number 317::":200~05 located at 1225_2, Boulder Point, Poway, CA,
desires to construct a 702 square foot detached. garage to the existing resi-
dence.
That in consi.derati'onof"the permission granted by the City of Poway by the
approval of a building p_t;rmit to allow construction of a 702 square foot
detached garage to an existing single-family home .does hereby covenant and agree
to and with said Tile CUy of 'Poway, a municipal corporation, that said accessory
unit shall never be rented, leased or otherwise used as a second unit and no
second kitchen shall e~er be installed.
That this agr:.eement shall run with the land for the protection and benefit
of all parties concerned, and that if the property shou.ld hereafter be conveyed
to any other person, firm, or corporation that the instrument by means of which
title or any interest in or to said real property, 'or any parcel thereof is con-
veyed will contain a restriction limiting the, use of the part or parcel so con-
veyed, or in the event ol the conveyance of the whole of said property
hereinbefore described, then to use the whole of sai.d property in keeping with
this agreement.
That if said agreement is violated at any t-ime, action shall be taken by the
CHyofPoway to revoke permission for use as herei.n stated.
