or are rescinded by City COllncil at the request of the OWNER, CITY,shall expunge
this Covenant from the record title of the PROPERTY.
If either party is required to incur costs to enforce the provisions of this
Covenant, the prevafHing party shall be entitl'ed to fU,ll reimbursement of all
costs, including r:e,asol)i1ble attorneys'fees, from,the other party. The CITY may
assign to persons, impacted by the performan'ce of this Covenant the right to
enforce this Covenantagai nst OWNER.

A RESOlUnON OF THE CITY COUNCIL
OF THE CITY Of' POWAY,CALIFORNIA
APPROVING VARiAN-cE 88-08 AND
MINOR DEVELOPMENT REVIEW 88-161
ASSESSOR'S PARCEL NUMBER 317-57.2-13
WHEREAS, Variance 88-08 and Minor Development Review 88-161, submitted by
Jeanne A. Daley, app.1 icant, reques ts a seven foot reducti on of the requi red 25
foot, front yard setback 'ar.ea for the reconstruction of a one story single family'
residence and room addition at 13316 Tarascan Drive in the Residentia,l Singre
Fcimily 7 zone; and
WHEREAS, on November 1, 1988, the City Council he 1 d a duly adverti sed pub 1 i c
heari'ng 'to solid tcomments from the pub 1 ic, both pro and con, re 1 ati ve to thi s
application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section '1: Environmental Findings:
ThiS project is Categorically ,exempt under:. the provlslons of CEQA (Class 2)
because it is a reconstruction of previously existing structure.
Section 2: Findings:
Variance 88-08
The City Council does hereby approve the variance for the front yard setback
on the following findings:
1. There are special circumstances applicable to the pr.operty or the
intended use that deprive the property of privileges enjoyed by other
properties. 'The property is a corner lot with an unusual con-
figuration. The shape of the lot, together with the steep banks on the
north, south, and we'st, largely limit the area available for
reconstruction or additions.
2. The granting of th,e variance is not necessary for. the preservation and
enjoyment of a substanti (!l pr9perty ri ght enjoyed by other properti es
fn the same, zone and, vicinity. 'Other properties in the vicinity; ar.e
typically dimensioned lots for the RS-7. zone and do not share the deve-
'-opment 1 imi tati onsof the subject property. Most of these residences
could be reconstructed or enlarged without the granting of a variance.
3. Granting the vilriance 'would not constitute a special privi'lege incon-
sistent with the limitations upon other proper.ties in the same zone and
vicinity.

4. That granting the variance or its modifiCation will not be materially
detrimental to the public health, safety, or welfare, or injurious to
the property or improvements in the vicinity and zone in which the pro-
perty is located. The reconstructed residence will be compatible in
design and scale with adjacent properties as it was prior to being
damaged.
5. That the granting of this variance does not anow a use or activity
which is not otherwise expressly authorized by the zoning regulations
governing the parcel of property.
6. That the granting of thi;! varianc'e or its modification will not be
incompatiole with the Poway City General Plan in that the site is
desi.gnated, for s.i ngl e ,fami.1y res identia 1 development.
Mi nor Development Re,vi ew 88-161
1. That the proposed development is in con.formance with the Poway General
Plan in that the proposed use issing,le family residential.
2. That the proposeddeve 1 opment will not have an ,adverse aes thetic,
health, safety, or architecturally related "impact upon adjoining pro-
perties, in that the roofline, 'construction method, building materials,
and elevations will be compatible with surrounding properties.
3. That the proposed development is in compliance with the Zoning
Ordinance, in that with the granting of the variance, it complies with
the property development standards of the RS-7. zone.
4. That the proposed development encourages the orderly and harmonious
appearance of structures and property'within the City, in that the pro-
perties to the west, soiJth, and east are under the same zoning designa-
tion as the ,subject lot and are developed as single-family residences
similar to the proposed project.
Section 3: City Councl1 Decision:
The Ci ty Council hereby approves Vari ance 88-08 arid Mi nor Development Revi ew
88-161 subject to the .follow,ing conditions:
1. Within 30 days of approval: (1) the applican,t shall submit in writing
that an condi.tions cif app'roval have been read and understood; and (2)
the property owner shall execute a Covenant on Real Property.
2. The property shall be developed in accordance with the approved site
plan and elevations on file with the Planning Services Department.
3. The appropriate Building Department ~pprovals shall be received prior
to initiation of construction.
