RESOLUTION NO. 09-055
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ELECTING TO BE EXEMPT FROM THE STATE CONGESTION MANAGEMENT
PROGRAM (CMP) PURSUANT TO ASSEMBLY BILL 2419
WHEREAS, Sections 65082, 65089, and 65089.3 of the California Government
Code requires the development, adoption, and updating of a Congestion Management
Program for each county, that includes an urbanized area; and
WHEREAS, Sections 65082, 65089, and 65089.3 of the California Government
Code also requires that the adopted Congestion Management Program to be incorporated
into the Regional Transportation Improvements Program; and
WHEREAS, On July 25, 1996, State legislators passed Assembly Bill 2419
amending Sections 65082, 65089, and 65089.3 of, and added Section 65088.3 to, the
Government Code, relating to Congestion Management Program; and
WHEREAS, Assembly Bill 2419 would make those requirements related to the State
Congestion Management Program inapplicable in a county in which a majority of local
governments, collectively comprised of the City Councils and the County Board of
Supervisors which, in total, represent a majority of the population of the county, adopt
resolutions electing to be exempt from the State Congestion Management Program; and
WHEREAS, On May 8,2009, SANDAG Board of Directors, as the lead agency to
prepare and regularly adopt the Congestion Management Program, directed staff to work
with local jurisdictions to prepare resolutions electing to be exempt from the State
Congestion Management Program pursuant to Assembly Bill 2419.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as
follows:
Section 1: In accordance with said Sections 65082, 65088.3, 65089, and 65089.3 of the
California Government Code and a request from SANDAG Board of Directors, the City of
Poway has elected to be exempt from the State Congestion Management Program.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway, at
a regular meeting, this 4th day of August 200L .
