TO ALL TOWHOK THESE PRESENTS SHALL COKE, GREETING:
'WHEREAS, Under the provisions of an Act of the Congress of the united
States, entitled "An act to provide for the survey of the public lands in
California, the granting of preemption rights, therein, and for other purposes,,"
approved Karch third, eighteen hundred and fifty-three, there was granted to the
State of California, the sixteenth and thirty-sixth sections of each township in
said State and lands selec1:ed in lieu thereof under the provisions of said Act
and also under the provisions of subsequent Acts of said Congress of the United
States; and whereas, the Legislature of the State of California has provided for
the sale and cDnveyance of said lands by statutes enacted frDm time to time; and
whereas, it appears by the certificate of Claire T, Dedrick, Executive Officer Df
the State Lands CDmmissionNo, 20),23, issued .inac,cDrdance with the prDvisions Df

land hereinafter described has been duly a a prDperly IDeated in accordance with
law, that the laws in relation thereto have been cDmplied with, that payment in
full has been made, and that the City of PDway, is entitled to receive a patent

Land Bank Trustee hereby grants to the City of Poway, the said tract of land
located, as aforesaid, and which is known and described as shown on Exhibit "A"

1. Reserving to the State of California, all minerals and mineral
deposits, including, but not limited to, oil and gas, other gases,
including, but not limited to nonhydrocarbon and geothermal gases, oil
shale, coal, phosphate, alumina, 'silica" fossils of all geological
ages, sodium, gold, silver, metals, and their compounds, alkali, alkali
earth, sand, clay, gravel, salts and mineral waters, uranium, trona,
and geothermal resources, together with the right of the State or
persons authorized by the State to prospect for, drill for, extract,
mine and remove such deposits or resources and to occupy and use so
much, of the surface of the lands as may be necessary therefore; first,
upon securing the written consent or waiver of patentee,

described herein, the absolute right of the people to fish thereupon,
as provided by Section 25 of Article 1 of the Constitution of the State
of California,

The SE 1/4 of the NE 1/4 of Section II, T14S, R2W, SBM.
-EXCE~TING THEREFROM that portion thereof described as follows:
BEGINNING at the most southwesterly corner of Lot 40 of
City of poway Tract No, 4113-3, according to the Map
thereof Number 11508, San Diego County Records; said
corner being on the southerly boundary of said poway Tract
4113-3, thence along said southerly boundary N 86024'33"
W, 62,09 feet,; thence'le~ving the southerly boundary of
said Tract 4113-3 along the arc of a non-tangent circular
curve concave easterly, having a radius of 330 feet, the
center of which bear,S ,N' 80008'40" E, through a central
angle of 31036'50", ana'rc length of 182,08 feet to a
