THIS LANDSCAPE MAINTENANCE EASEMENT lsgranted by ROBERT J.
WESTON and COLLEEN D. WESTON, husband and wife ("Weston"), to the
CITY OF POWAY, California, a municipal corporation ("city"), with
reference to the following
RECITALS:

A, Weston owns, the real propert:y located in the City of
Poway, County of San Diego, California, described as:
Lot 4 of CITY OF POWAY THACT NO. 4090-R
according to Map thereof No. 11360 filed in
the Office of the County Recorder of San
Diego County, California, on October 24, 1985
("Servient Tenement"),
B, City has establi'shed Landscape Maintenance District 86-
01 for the purpose of maintaining landscaping within certain
portions of city,
C, City wishes to include portions of the Servient
Ten",ment within Landscape Maintenance District 86-01 and Weston
wishes to place portions of the Servient Tenement within Land-
scape Maintenance District 86-01.
NOW" THEREFORE, for good and valuable consideration, Weston
grants to city and City accepts, the following easement:

1. Grant of Easement. Weston grants to City a non-
exclusive; easement j'n gross on, over, under and across that
portion of the, Servient Tenement which is included within the
property description attached to this Agreement marked Exhibit
"A" ahd by this reference made a part of this Agreement.

3. Standards of Maintenance. City shall maintain the
easement in a neat, clean and attractive appearance.

-the -owne.c(s) of 'the Servient 'renemei'lt arising out of or in
connection with this, easement, the prevailing party shall be
entitled to costs of suit and reasonable attorney's fees.
