THIS LANDSCAPE .MAINTEN~CE EASEMENT ip granted by IMPERIAL
SAVINGS ASSOCIATION, a California corporation ("Imperial"), to
the CITY OF POWAY, California, a municipal corporation ("city"),
with reference to the following
RECITALS:
A. Imperial owns the real property located in the City of
Poway, County of San Diego, California, described as:
Lots 1, 2 and 3 of CITY OF POWAY TRACT NO.
4090-R according to Map thereof No. 11360
filed in the Office of the County Recorder of
San Diego County, California, on October 24,
1985'("Servient Tenement").
B. City has established Landscape Mail}tenance, District 86,-
01 for the purpose of maintaining landscaping wfthin certain
portions of City,
C, city wishes to include portions of the Serv~ent
Tenement within Landscape Maintepancei)is,trict 86-0'1 and Imperial
wishes to place portio,ns of the Servient Tenement within Land-
scape Maintenance D,istrict 86-()1.
NOW, THEREF:ORE.1 for good and valuable consideration,
Imperial grants to City and city accepts, the following easement:

1. Grant of Easement. Imperial grants to city a non-
exclusive, ea,sement in gross on, over, under and across that
portion of the' Servient Tenement which is included within the
property description attached to this Agreement marked Exhibit
"A" and by this reference made a part of this Agreement.
2, Purpose

facilities,
and Use. The easement granted herein is for
use, operation, maintenance, repair, removal
of landscaping and irrigation and drainage
3. Standards of Maintenance, City shall maintain the
easement in a neat, clean and attractive appearance.
4. oisDute. In the event of litigation between City and
the 6wner{s) of the Servient Tenement arising out of or in
connection with this easement:, the prevailing party shall be
entitled to costs of suit and reasonable attorney's fees.
