applicants, request~_iathree foot r;,eduction of the required 20 foot

NOW, THEREFO~E, the City of ~9wilY' <:'IO,~? hereby resolve as
follows:
Section 1: -Envi:J:''tihmental FindTh'qs:
The project is e}{eI]\p'f f,rom EnvironIl!~l'!tal Review. It qualif'ies
for a Class 5 categoJ::' ical exemptiorJ. 'pecause the variance is a
minor alteration to' lahd use limi,tations.
Section 2: Find'hi'qs:
1," rhe,re ar", spec~al cir,cumstilncep applicable to the p;:gpElr,ty
(si z'e, shape:,tbpography, locat'ion, or surroundings), or
the intended, use of the property, and because of this, the
strict appli'cation of the Zoning' Ordinance deprives the
property of privileges enjoyed by other properties in the
vici'nity unde,ridentical zoning classifications.
The special' circUmstances consist of the grade separation
between the subje'c,t lot ahd adjacent prop'erty and the
si tihg, of ,the, ej{'i"st'ihg~ garage and guest house on the
property.
,2. Granting the var1ance or ,it's modification is necessary for
the preservat,ionand enjoyment of a substantial. property
right. possessed by other property in the same vicini.ty and
zone and denied to the property for which the variance is
sought.
Grantin'g of the variance will. allow the applicant 'to
construct a kitchen addit'ion in, a logically si tuated area
given, existing plumbing and other improvements on the lot.

homes in thevicirH ty'. They contain structures which
encroach into the 20 foot side yard because the area was
developed under county of San Diego standards which
required a 15 foot rather than a, 20 fbot side yard
setback.
3. Gran'ting "the variance or its modification will not be
materially detrimental to the public health, safety or
welfare, or injurious to the proper'ty or improvements in
~fich vicinity and zone in which the property is locafed.
Because of the minimal size of the encroachment, there will
be no detrimental impact on public safety or welfare, and
the modification will not be injurious to other property
in the vicinity.
4. The granting of this vari~ncedoes not constitute a
special pr,ivilege inconsistent wi th the limitations upon
other properties in the vicin,ity and zone in which such
property is situated.
The variance will not constitute a special privilege
because many ,other properties encroach into the side yard
setback at the present time.
5. The granting of this variance does not allow a use or
activity which is not otherwise expressly authorized by
the zoning, regfi1~t'ion governing the parcel of property.
The proposedc6riitruction of a kitchen addition is an
exp~hsioh ofafise which is permitted by the RR-C zone.
6. That granting the variance or its, mo?;ification will not be
incompafi'b1:ewi,th the City of PowayGenera1 Plan.
Due to 'the minor ,natur,e, of the variance reques'ted, no
adverse impact ontlle General plan is anticipated.
Section!: City Council Decision:
The City Council hereby finds that Variance 88-04 is approved
sub ject to the following cond'itions::

mi t, in wr itin'g that", all condTtiions of approv~l have been
read and ~ndeistood; and (2) the property owner shall exe-
cute a Notice of Restriction on Real ~roperty.

addition sha'll be architectura'lly compatible with the
existing home.
3. Approval of this variance' request shall not waive
compliance .'w,ith all other sections of the Zoning
Deveiopment Code and all other applicable City ordinances
ih ef{ect at the time of buflding permit issuance.
4. The applicant shall c:6inplywith the latest adOpted UriH6rm
Build~ng <:;od<::" Uniform Mechanical Code, ,Uniform Plumbing
,Co<j'e, Na'ti"onal 'Electric Code ',Uniform Fire. Code, and all
other applicable code and ordinances in effect at the time'
of building permit issuance.
