In the event that Conditional Use Permit Modification 85-03 and Oevelopment
Rev,iew 88~32 expi re or are rescinded by City Council at the request of the
OWNER, CITY shall expunge this Covenant from the record title of the PROpERTY.
If -either party is required to incur costs to enforce the provisi'ons of this
Covenant, the preva,iling party shall be entitled to, full reimbursement of all
costs, jncluding reasonable attorneys' fees from the other party. The CITY may
assign to persons impacted by the; perform ce of thi.s Covenant the ri'ght to
enforce this Covenant against OWNER. ~

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY" CALIFORNIA
APPROVING MODIFICATION TO CONDITIONAL USE PERMIT 85-03
AND DEVELOPMENT REViEW 88-32
ASSESSOR'S PARCEL NUMBER B23~190-58
WHEREAS, Con.ditional Use Permit Modification 85-03 and Development Revie\'l
~8-32, submiJted by Poway Honda, Tony Batarse, applicant, requests approval to
recate an expansion oJ the auto sales fac;il ity to the northeast corner of Poway
Road and oi.i ve Tree Lane, i ri the MS (Man,ufacturi ng Service) zone; and
W~EREAS, on March 7, 1989, the City Council held a duly advertised public
hearing to soli,cit comments from the public, both pro and con, relative to this
appl ication.
NOW, THEREFORE ,the City Counc i ,1 does hereby reso'l ve as fo 11 ows :
Section 1,: Environmental, Findings:
The City Council finds that the project is categorically exempt Class n.
Secti on 2': Fi nd; ngs;:
1. That the location, size, design, and operating characteristics of th~
propose,(j use \yill be compatcible with and will nof adversely affect or
be materially detrimental to adjacent uses, residents, buildings"
structures, or natural resources, because it is an extension of the
manufacturingservic-e' acti,vity already present in that area.
2. That the \1armony in, scale, bulk, c.overage, and density is consistent
with adjacent uses, ,because the new di splay area wi 11 be landscaped and
li ghted to match the ex i sting sa 1 es agencY.
3. That there are avaflable public facilitt€'s, services, and utilities.
The use will be associated with an existing commercial building.
4. That there Iti n not be a harmfu 1 effect upon desi rab 1 e nei ghborhood
characteristics" in that most surrounding land uses are of a commercial/
manufacturi~g nature.
5. That the generation ,of traffic wj1l not adversely impact the
surrounding streets and/or the C,ity"s Circulation Element.
6. That the site is suitable for the type and intensity of use or develop-
ment which is proposed" in that it is in a manufacturing location.
7. That there will not be significant harmful effects upon environmental
qual ity and natural resources.

8. That there are no other relevant negative impacts of the proposed use
that cannot be mitigated.

Se'ction 3: Cit.y Council Decision:
TIle City Council hereby approves the modification to Cond.itional Use Permit
tJS-u3 and Development RevAew 88-'32 subject, to the follo'wing conditions:
1. Within 30 days of approval: (1,) The applicant shall submit in wr"ifing
t,ha 1. all cond it ions of approva 1 have been read and understood; and (2)'
the property owne'r shall execute a Covenant Regarding Rea 1 Property.
2'. The applicant shall submit a revised site plan delineating the revised
1 ocati ons, of dispi'ay pockets, on Poway Road and 01 i ve Tree Lane.
3. A formal landscape a~d 'jrrigation plan shall be approved by the
Planning Services Department and installed prior to placjng any cars
for display :o"n the rJ~w lot. _ .. _
4. Within 45 days of approval, applicant shan cease all use Of amplified
soun,d and, therefore" no further use of amplified sound systems wjll be
permitted either Tor the new or existing dealership site.
5. Approval of this request shall not waive compliance with all sections
of the Zoning Development Code and al,l other applicable CityOrd,inances.
6. Prior to any use of ~he, project site or businessactivi,ty being com-
menced thereon, all cond,i ti on scif approval contai ned herei n shall be
completed to the 'sat'isfaction of the Director of Plannning Services,
7. Ahy si'gns proposed for th'is development sha,l 1 be designed and approved
in conformance with the City of Poway Sign Ord.inance.

9, Repair any broken curb, gutter, and/or sidewalk along either street
frontage which may be damaged during construction to the satisfaction

Poway ~oad landscape median.
