of the State of Cal iforni,a" commencing at Section 8330; and
WHEREAS, the dr;ai'nage easement adjacent to So.u.th Poway Parkway was
dedi catE:d to and ac'cepted by said City through recordati On of a deed as
Document No. 88-296326 on June 23, 1988 in the Office of the County Recor"
'der; and
WHEREAS, subsequent to' sa,id recordation, the sa,id easement was never
ut,il ized for its intended'purpose; and
WHEREAS, the develoP?p, tF Poway, Ltd., has submjtted improvement plans
and, a tract map ,whi ch wil,:lprov:i'ae .for a substi tute easement and a
permanent drainage facil i tyas part of Pomerado Bus i ness Park, Phase I!.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows:
1. This summary vacation is made under the provisi,ons of Chapter 4,
Part 3, Division 9, of the Streets and Hi~hway~ Code of the State
of California.
2. The City Counci I hereby fi nds that the h,ereinbelow descri bed
dra i nage easement has been superseded by re locat i on and there
are no oth~r:' publ ic faCilities, located within t'he easement,
(Section 8333c),
3. The City Council hereby. declares that the hereinbelow described
draihage easement is vacated:
