COVENANT REGARDING REAL PROPERTY
Robert E. Faaborg and Delora M. Faabor9, ,husband and wife, as joint tenants,
as to an undivided. one-half interest, and Robert A. Faaborg, a single man,
William H. Faaborg, a single man, and James E. Faaborg, a single man, all as
joint tenants, as to an undivided one-half interest as tenants in common
("OWNERS" hereinafter) are the ownesr of real property described in Exhibit A which
is attached hereto and made apart hereof and which is commonly kno,wn as
Assessor's Parcel Number 323-270-20 ("PROPERTY" hereinafter). In "consideration
of the approval of Minor Condit.ional Use Permit 88-12 by the City of Poway
("CITY" herei nafter), OWNER hereby covenants and agrees for the benefi t of the
CITY, to abide by conditions of the attached resolution (Exh'ibit B,).

Thi s Covenant shall r;un with the land and be bi ndi ng upon and inure to the
benefit of the future owners, encumbrancers, successors, heirs, personal
representatives, fransferees and assi gns of the respecti ve parties.

The City shall record a releas~ of this covenant upon the request of OWNER
when Minor Conditional Use Permit 88-12 has. been terminated.

I'f either party is required to incur costs to enforce the provlslons of this
Covenant, the prevail ing party shall be entitled to full reimbursement of all
costs, including reasonable attorneys' fees, from the other party. The CITY may
assign to persons impacted .by the performance of hi Covenant the right to

APPROVING MINOR COND IT.IONAL. USE PERMiT 88-12

WHEREAS" Mi nor Cond.i ti ona 1 Use Permit 88-12, submitted by Poway Hi gh School
fiandilooster~ and Robl;rt and Delora Faaborg, appricants, requests apprciva:lto
1 ocate a re'cycl ing center at 14228 Garden Road in the - MS (Mar1UfacturingServi'ce)
zone; and
WHEREAS, on September ~, 1988, the City Council held a duly a~vertised publi~
heariD9 to solicit comments from the publ'ic,. both pro and con, relative to this
application.
NOW, THEREFORE, the City Council does hereby resolve as follows:
Section 1: Environmental Fi~dings:
The City Council fInds that the project will not have a significant adverse
impact on the environment and hereby issues 'a' Negative Declaration with
mitigation measures.
Section 2: Findings:
1. That the location, size, design, and op~rating characteristics of the
proposed use wi 11 be conipati b 1 e wi th and will not adverse ly affect or
be materially detrimental to adjacent uses, residents, buildings,
structures, or natural resources, because it is an extension of the
manufacturing service activity already present in that area.
2. That the harmony in scale, 'bulk, cover.age, and density is consistent
with adjacent uses, because the'recyclih'g center will be located behind
the main-buildings and will be fully'screened.
3.' That there .are available public facilities., services, and utilities.
The use will be assoCiated w'ith an existing 'commercial building.

recycling center contributes to the achievement of a regional goal of
reducti on of the 's'ol i d waste stream to county Jandfi 11 s.

That. there are no other relevant negative impacts of the proposed use

9. That the impacts, as described above, and the location of the proposed
use will not adversely affect the City of Poway General Plan for future
as well as present development.
Section 3: City Council Decision:
The City Council hereby approves Minor Conditional Use Permit 88-12 subject
to the following condftions:
1. Within 30 days of approval: (1) The .app1icant shall submit in writing
that all conditions of approval have been read and understood; and (2)
the property owner shall execute a Covenant Regard i ng .Rea 1 Property.
2. The applicant will prov.ide, the City with a copy of the State licens'e
permitting operation of the subject recycling center.
3. The applicant shall ensure that the recycling containers are emptied on
a regular schedule so that they will at no time become full enough to
become a hazard to public health or safety.
4.. The recycling center shall be operated and :supervised in a manner to
ensure that the area is well-maintained and. litter-free at all times,
and that all 1 andstapi ng is kept in a healthy. thri vi ng, and weed-free
condition. .
5. Hours of operation, including maintenance, shall be limited to between
9:00 a.m. '.and 4:00 p.m. on week days., and Saturdays 8:00 a.m. to 8;00
p,.m.
6. Al1 mechanically driven equipment shall be totally enclosed within a
structure and shall be sou_nd buffered, to the satisfaction of the
Director of P,l ann i ryg Serv,ices.
7. An l8fo.ot wide paved driveway sha.1J bei nsta 11 ed as access to the
rearyard area. A paved parking area sufficiently large enough to meet
aver'age demand of this facility shall be instaUed to the satisfaction
of the Directors of' Planning and Safety Services.
