USE PERMiT 88-12 'ASSESSOR'S PARCEL NUMBER 323-270~20 WHEREAS" Mi nor Cond.i ti ona 1 Use Permit 88-12, submitted by Poway Hi gh School fiandilooster~ and Robl;rt and Delora Faaborg, appricants, requests apprciva:lto 1 ocate a re'cycl ing center at 14228 Garden Road in the - MS (Mar1UfacturingServi'ce) zone; and WHEREAS, on September ~, 1988, the City Council held a duly a~vertised publi~ heariD9 to solicit comments from the publ'ic,. both pro and con, relative to this application. NOW, THEREFORE, the City Council does hereby resolve as follows: Section 1: Environmental Fi~dings: The City Council fInds that the project will not have a significant adverse impact on the environment and hereby issues 'a' Negative Declaration with mitigation measures. Section 2: Findings: 1. That the location, size, design, and op~rating characteristics of the proposed use wi 11 be conipati b 1 e wi th and will not adverse ly affect or be materially detrimental to adjacent uses, residents, buildings, structures, or natural resources, because it is an extension of the manufacturing service activity already present in that area. 2. That the harmony in scale, 'bulk, cover.age, and density is consistent with adjacent uses, because the'recyclih'g center will be located behind the main-buildings and will be fully'screened. 3.' Section 3: City Council Decision: The City Council hereby approves Minor Conditional Use Permit 88-12 subject to the following condftions: 1. Within 30 days of approval: (1) The .app1icant shall submit in writing that all conditions of approval have been read and understood; and (2) the property owner shall execute a Covenant Regard i ng .Rea 1 Property. 2. The applicant will prov.ide, the City with a copy of the State licens'e permitting operation of the subject recycling center. 3. The applicant shall ensure that the recycling containers are emptied on a regular schedule so that they will at no time become full enough to become a hazard to public health or safety. 4.. The recycling center shall be operated and :supervised in a manner to ensure that the area is well-maintained and. litter-free at all times, and that all 1 andstapi ng is kept in a healthy. thri vi ng, and weed-free condition. . 5. Hours of operation, including maintenance, shall be limited to between 9:00 a.m. '.and 4:00 p.m. on week days., and Saturdays 8:00 a.m. to 8;00 p,.m. 6. Al1 mechanically driven equipment shall be totally enclosed within a structure and shall be sou_nd buffered, to the satisfaction of the Director of P,l ann i ryg Serv,ices. 7.
