COVENANT REGARDING REAL 'PROPERTY
J, Patrick Flemin9, an unmarried man ("OWNER" hereinafter) is the owner of
real property described in Exhibit A which'is attached hereto and made a part
hereof and which is commonly known as Assessor's Parcel Number 321-191-11
("PROPERTY" hereinafter). Inconsi,deration ot the approval of Conditional Use
Permi t 88-16 by the City of Poway ("CITY" hereinafter). OWNER hereby covenants
and agrees for the benefit of the CITY, to ,abide 'by conditions of the attached
resolution (Exhibit B),
Thi s Covenant shall run wi th the I and and be b indi ng upon and inure to the
benefi t of the futUre owners, encumbrancers, suCcessors. hei rs. pe'rsonal
representatives, transferees and assigns of the respective parties.
In the event that Conditional Use Permit 88-16 expires or is rescinded by
City Council at the request of the OWNER, CIlYshal,l expunge this Covenant from
the record title of th~ PROPERTY.
If either party is required to incur costs to enforce the provisions of this
Covenant, the preva,iling party shall be entitled to full reimbursement of all
costs, including reasonable attorneys' fees, from the other party. The CITY may
ass i gn to persons impacted by the performance of thi's Covenant the ri ght to
enforce this Covenant against OWNER.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA
APPROVING CONOITIONAL USE PERMIT 88-16
ASSESSOR'S PARCEL NUM8ER 321-191-11
WHEREAS, Conditional Use 'permit 88-16 submitted by Cox Cable San Diego,
applicant, for the purpose of' constructing a microwave antenna station on the
real property situated in the City of Poway, County of'San Diego, State of
C~lifornia, described as a portion of Parcels 1 and 2 of Parcel Map No. 5067,
filed in the office of the County Recorder of San Diego County, September 2,
1976 as File No 76-28883 of official record, re'guTarly came before the City
Council for public hearing and action on January 17,1989; and
WHEREAS, the City Counc51 has read and considered said report and has con-
sidered other evidence presented at the public hearing.
NOW, THEREFORE, the City Council of the City of Poway does hereby resolve as
follows: '

Section 1: Environmental F'indings:
The City Council finds that the project will not have a significant adverse
impact on the environment and hereby issues a Nega"tive Declaration with
mitigation.
Section 2: Findings,:
1. That the location, size, design, and operating characteristics of the
proposed use willll.e compatible with and will not adversely affect or
be materially detrimental to adjacerit uses, residents, buildings,
structures" or natural resources, in that the siting of utilities
withi n res i denti ill nei ghborhoods is found to be a necessary servi ce to
the community.
2. That the harmony in scale" bulk, coverage, and densi,ty is con'sistent
with adjacent uses, in that the support structure will be fully
screened by shrubs and trees.
3. That there are available public facilities, services, and utilities to
the new structure,
4. That there will not be a har~ful effect upon desirable neighborhood
characteri st'ics, irithat the proposed structure can be screened and
painted so as to blend with its surroundings.
5. That the ~eneration of traffic will not adversely impact the
surrounding street and/or the City's C.irculation Element, in that no
significant traffic will be generated by the structure.

6. That the site is suitable for the type and intensity of use or develop-
ment which is proposed, in that it is a minor ridgel ine which provides
the proper reception characteristics.
7. That there will not be significant harmful effects upon environmental
qual ity and natural resources.
8. That there are no other relevant negative impacts of the proposed use
that cannot be mitigated.
g. The proposed use wi]"l not adversely affect the City of Poway General
Plan for future as well as present development.
Section 3: City Council Decision:
The City Council hereby approves Conditional Use Permit 88-16 subject to the
following conditions:
Within 30 days of approv,al: (1) The applicant shall submit in writing that
all conditions of ap~roval have been read and understood; and (2) the pro-
perty owner shall execute a Covenant on Real Property,
Miscellaneous
1. The, antenna support structure shall be Sccreened by the existing shrubs
and ,trees. The!' shrubbery shall be retained as indicated on the
approved plans.
2. The microwave dish and visible portions of the support structure shall
be painted, a gray-blue so as to blend with its surroundings.
3. This Conditional Use Permit is granted for a ~eriod of one year at the
end of ,which time the City Council may add or delete conditions, or
revoke the Conditional Use Permit.
4. 'The applicant shall comply with the latest adopted Uniform Building
Code and all other appl icable codes and ordinances at the time of
building permit issuance.
