MELVIN C, MC KAY AND ROBERTA M, MCKAY. HUSBAND AND WIFE AS JOINT TENANTS
hereinafter "GRANTOR") hereby grants to CITY OF POWAY, (hereinafter'''GRANTEE''), its
successors, or assigns; the right-of-way and incidents theretoforapublic'street upon; over and across
that certain real property in the City of Po way, County of San Diego, State of California, described as
follows:
(See Parcel A and attached Exhibits A and B)
The GRANTOR, hereby furtner grants to the City of Powaythe privilege and right to extend drainage
structures and excaliationand embankment slopes within theJimitsof the herein described right-of-
way, as described in Parcels'S and D: where required for the construction and maintenance of said
City Street. In addition, the ,GRANTOR hereby further grants to.the City of Poway the privilege and
right to landscape and maintain theslope,easement as described in Parcel B, The City will install and
maintain landscaping as shown onJandscape plans for Espola Road Improvements of 1998,
RESERVING unto GRANTOR of the above described parcel of land, his successors or assigns, the
righfto eliminate such slopes and/or drainage structures or portions thereof, when in the written
opinion of the City EngineerofGRANTEE, the necessity therefore is removed by substitutingbther
protection, support and/or drainage facility, provided such substitution is first approved in writing by
said Engineer.
The GRANTOR hereby further grants to GRANTEE all trees, growths (growing or that may hereafter
grow), and road building materials within said right-of-wClY, including the right to take underground
water, together with the Tight to use,thesame in such manner and ai:such locations as sa,id GRANTEE
may deem proper, needful or necessary, in the construction, reconst~uction, improvemeni or
maintenance ot'said highway,
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives any claim for any and
all severance damages to GRANTOR's remajning property contiguous to the right-of-way hereby
conveyed by reason of the'location, construciion,landscaping or maintelJanceof said nighway,

The GRANTOR'herebyfurther grants to GRANTEE the righttotemporarily enter and construct
necessary related impro,vementsas part of the proposed construction process. This Temporary
Construction,Easement, as described, in the attached Exhibit as Parcel D,shallbe valid only until the
construciion has been accepted by the GRANTEE, After such time, the Temporary Construction
Easement shall become null and void,
