are the ownersbf real property described in Exhibit A which'is attached hereto and,madea part hereof and
which is, commonly 'known as Assessor's Parcel Number 321-1.91-18 (PROPERTY" hereinafter), In
consideration of the approved building-permit to construct an 880 square'foot Cabana, OWNERs hereby
agrees thatthe Cabana,shall never be rented.or leased as a separate:'unit, and kitchen facilities shall never
be installed without first obtaining ,the required approvals and permits from the City of Poway,("CITY"
hereinafter),
This 'Covenant shall run with the land.and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parti'es,
In the event that ,building, permits are never obtained to construct the proposed 880 square foot
Cabana,atthe request of the' OWNERs, the CITY shall expunge this Ebvenant from the record title of the
PROPERTY,
If either party is requir,ed to, incurs.osts to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement blallcbsts, including reasonable, attorneys"fees, from the other party,
The CITY may assign to personsinipactedby the performanceofihis Covenant the right to enforce this
Covenant against OWNERS,
