ORDINANCE NO. 695
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA
AMENDING SECTION 13.11.010 OF THE POWAY MUNICIPAL CODE, SCHEDULE OF
WATER SERVICE CHARGES, AND ESTABLISHING WATER RATES
WHEREAS, the City of Poway provides water service to citizens of Poway; and
WHEREAS, the City's current water rates were approved in 2007 for the three-year
period of 2008-2010; and
WHEREAS, the City purchases 100% of its water supply from the San Diego County
Water Authority (CWA); and
WHEREAS, the cost to the City of purchasing raw water from the CWA has increased
substantially due to rate increases imposed by CWA and the region's water wholesaler, the
Metropolitan Water District (MWD), which have been substantially higher than the wholesale
price increases that were originally forecast; and
WHEREAS, while wholesale water rates are increasing, the regional water supply is
being reduced based on a number of factors, including court ordered reductions in water
supplied from Northern California due to environmental issues, and a third consecutive year
of drought; and
WHEREAS, on June 2, 2009, the City declared a Level 2 Water Shortage Alert,
consistent with Chapter 8.94 of the Poway Municipal Code, due to the ongoing drought and
recent water supply cutbacks; and
WHEREAS, because of the decreasing water supply to the region, and the City's
increased costs for providing water service, it is necessary for the City to implement a
progressive water rate structure that promotes conservation, in addition to raising sufficient
revenue to pay for the City's costs of providing service; and
WHEREAS, for the foregoing reasons, the City of Poway wishes to replace its current
uniform rate with an inclining block rate structure, where water rates increase as
consumption increases, to be effective with the September/October 2009 bills and the
March/April 2010 bills; and
WHEREAS, the proposed rate structure also includes authorization to staff to pass
through future unanticipated increases to wholesale water rates or reclaimed water rates
imposed upon the City of Poway from 2009-2014, as authorized by Assembly Bill 3030
(Government Code section 53756); and
WHEREAS, the San Diego County Taxpayers Association supports a tiered/block
water rate structure that promotes water conservation and recovers fixed costs; and

WHEREAS, a duly noticed public hearing was held regarding the proposed water
rates on July 21, 2009, pursuant to the requirements of California Constitution Article XIIID
(otherwise known as Proposition 218), and there was no majority protest frorn the City's
water customers that would preclude the City Council from approving the proposed rates.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS:
Section 1: Section 13.11.010 shall be amended to read as follows:
13,11.010 Schedule of water rates.
The water rate schedule is hereby established as follows for all water billed
beginning on the September/October 2009 bills.
A. Water Capacity. Every water customer pays a bi-monthly water service
charge regardless of customer class. The fee is based upon meter size. Most residential
water customers pay the 5/8-inch, 3/4-inch charge.

B. Water Commodity. In addition to a water capacity fee, every customer pays
for each unit of water registered through his or her meter (commodity). Each unit is
approximately 748 gallons.

C. Special Water Rates.
1. Raw Water. The basic raw water rate will be the raw water cost from
the County Water Authority, associated fixed charges, as well as a surcharge
as established by separate agreement.
2. Reclaimed Water. At this time, reclaimed water is only available in our
business park. The reclaimed water rate is 90 percent of the Block 3 water
commodity rate then in effect.
D. Pumping Charges. Some water customers are in areas that require water
pumping. Customers within one of these areas are required to pay a per-unit
pumping charge to offset actual electricity costs. This charge may be adjusted
no more than once bimonthly.

Section 2. That the setting of such charges and rates is categorically exempt frorn the
requirements of CEQA, pursuant to Section 21080(b)(8) of the Public Resources Code, and
Title 14 of the California Code of Regulations, Section 15273 and 15307.
Section 3. Future unanticipated increases to wholesale water rates or reclaimed water
rates imposed upon the City of Poway from 2009-2014, as authorized by Assembly Bill 3030
(Government Code section 53736) will be passed through to water customers.
EFFECTIVE DATE: This ordinance shall take effect and be in force thirty (30) days
after the date of its passage; and before the expiration of fifteen (15) days after its passage,
it shall be published once with the names of members voting for and against the same in the
Poway News Chieftain, a newspaper of general circulation published in the City of Poway.
Introduced and first read at a Regular Meeting of the City Council held on the 21st
day of July 2009, and thereafter PASSED AND ADOPTED at a regular meeting of said City
Council held on the 18th day of August 2009, by the following roll call vote.
