CREATING SPECIFIC PL,A;N 98~01

WHEREAS, Section 65450 etseq of the California Government Code (Article 8,
Specific Plans)' provides for the preparation and adoption of-specific plans; and,

WHER~S, in May, 1996 the City Council adOpted Resolution 96-039 approving the
Poway Road Specific Plan; and
WI::IEREAS,subject.parcels, APN 317-130-42,66.67,&68 were located within the

boundaries of SP 95~01 and the Town Center zone; and
WHEREAS, on September 8. 1998 the City Council approved General Plan
Amendment/Zone Change 98-o2A and B redesignating four parcel located south of
Hilleary Place between Community Road and Midland Road from Town' Cent~r to
Commercial General, and
WHEREAS, in conjuncticinwiththe General Plan Amendment/Zone Change the City
Council directed staff'to prepare a specific plan to limit the types of uses permitted on the
aforementioned parcels; and
WHEREAS, on October 6, 1998 the City Council approved Specific Plan
Amendment 95-018 (SPA 95"01 B) removing the subject parcels from the boundary ofthe .
Poway RoM Specific Plan; and
,
WHEREAS. on October 6, 1998 the,City Council held a properly noticed public hearing in,
accordance with the California Government Code and the California Environmental Quality
Act (CEQA) to consider adoption of Specific Plan 98-01 ; and
NOW, THEREFORE, BE IT QRDAINED by ,the City Council of the City of Poway the
following:
Section 1: The City Council of the' City of Poway finds that the Negative
Declaration adopted in association with General Plan Amendment/Zone Change 98-o2A
&B adequately addressed the potential environmental impacts associated with this
application,
Section 2: Specific Plan (SP98-01) is hereby adopted.
