the'Ciiy of Poway ("CITY~"hereinafter) to convert an unfinished"basement'into a 390 squa,e fClot rec,eation
room, OWNER hereoyagrees that no portion of the re~'eation room ,shall ever be rented or leased as a
separate unit and kitchen facilities shall never be installed without first obtaining the required'approvals and
permits from the City of Poway,
This Covenant'shall ruh with the land and be bindi,nguponand inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that buiiding'perrTiits are never obtained toconstruct,the proposed guest house at the
,requestof the OWNER, the CITY shoW expunge this Covenanlfrom the record title of the PROPERTY,
If eithefparty is required to incur costs to,enfo,ce the provisions of this Covenailt, the prevailing,party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
The CITY may'assign'to persons 'impacted by the performance of this Covenant the right to enforce this
'Covenant against OWNER.
