COVENANT REGARDING REAL PROPERTY
MARK T, MADDEN and CHRISTINE MADDEN ("OWNERs" hereinafter) are the owners of real
property ,described in Exhibit Awhith is attached hereto and m.ade a part hereof and which is commonly
known as ,Assessor's Parcel Number 321,1.80-12 (PROPERTY" hereinafter), In consideration of the
approved building-permit to construct a 930 square foot detached garage with guest quarters, OWNERs
hereby agrees that the garage wiih guest quarters shall never be"rentedor leased as a separate unit, and
kitchen facilities shall never be installed withoul first obtaining the required approvals and permits from the City
ofPoway;("CITY" hereinafter),
~ This Covenantshall run ,with Ih~ land and be binding upon and inure to the benefit ofthe future
owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of Ihe
respective parties,
, In the event that building permits are neverobtained to construct the proposed 930 square foot
detached'garage with guest quarters at the request of the OWNERs, the ,CITY shall expunge this Covenant
from the record title of the PROPERTY,
If either party is required to incur costs to enforce the provisions of this Covenant, the prevailing party
shall be entitled to fullreimburserhent'of.<liIcosts, including reasonable'altorneys' fees, from the ,other party,
The CITY may assign to persons im'pacted by the performance,o(this Covenant the right to enforce this
Covenant against OWNERS,
