Extlibit;A which is!aitached hereto and made a part hereof and which is commonly known .as Assessor's

parcel Number275-270~38 ("PROPERTY" hereinafter). In consideration of the approval .of Minor
DevelopmentReview 98-21 and an approlied building permit to construct a604 square foot det!,ched guest
house bitheCitYofPoway ("CITY" nereinafter), OWNER hereby agrees that no portion of theguest"house
shall ever be rented or leased as a separate unit and kitchen facilities shall never be installed without first
qbtainingthe required' approvals and permits from the City of Paway. .
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrancers, successors, heirs, personal representatives, iransferees and assigns of the
'respective parties',
In the ev.ent that building, permits are never. obtained to construct the proposed guest house at the
request of the OWNER, the CITY shall expunge this Covenant from'theTecord title of the'PROPERTY.
If either party is requ,iredtotncur costs to enforce the. provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees; from the other party.
The CITY may assign to persons impacted by the peiiormance of this Covenani the right to enforce this
Covenant against OWNER.
