AMENDMENT
This easement is amended to clarify the intent and understanding
between the parties involved due to the value placed on the trees on the
easement.
It is understood that during the construction phase of the proposed
sewer that no more than six (6) trees in the southerly end of the easement
that are greater than~ 3 inches in diameter and less than 7 inches in
diameter will be removed. Also, that .no trees greater than 7 inches in
diameter will be removed from the, easement durirfg"the construction phase.
Paragraph 4 shall be replaced as follows:
The Grantor may at his own risk use the surface of the above
described real property,in a manner that will not interfere with or be
detrimental to the use of said easement and right of way by Grantee, its
successors and assigns.
The' Grantor 'also agrees that for the purpose of construction and
maintenance that the area to the .east of the easement may be used for
access to the easement to reduce damage to'existing and future growth.
