WHEREAS, Subdivision (b) of Section 8324 of the Streets and
Highways Code provides that the legislative body may adopt a resolution
vacating any street, highway or public' service easement; and

7:00 P.M.. and evide"nce being on file that due and. proper notice of said
hearing has been given as ~equired by law; and
WHEREAS, the Dep,artment of Planning and Land Use, in its report
filed in the office 'of the Clerk of the Cfty,of poway on February 23,
1981, recommended that the City Council approve the'vacation requested by,
the Department of Transportation;
NOW THEREFORE IT' ISI.:R}'SOLVED AND OlUJj;;IlED that the hear ing be ,alld
it. is hereby closed; that the 's'ubject right-of-way is not useful as a non-
motorized transportation facility and that the proposal is not subject to
the env~Fonmental review process; and
BE IT FURTHER RESOLVED that the City .Co.uncil does hereby vacate
and abandon the hereinafter d'escr.ibed Ci ty highway pursuant to the
procedures prescribed by Chapter 3 (commencing with Section 8320), part 3,
Division 9 of the Streets and Highways Code.
