WHEREAS; the City Council of the City of poway desires to summarily vacate
,a certain public service easement in accordance with the procedures provided i,n
Chapter 4, Part 3, Division 9 of the Streets and Highways Code of the State of
California, commencing at Section 8330; and
WHEREAS, a drainage easement within the attached legal description titled
"Exhi&it A" was dedicated to the City per Parcel Map 14824 recorded as File No.
87-29D445 on February 27, 1987 in the Office of the County Recorder.
NOW, THEREFORE, BE IT RESOLVED by the City Counci 1 of the City of Pbway as
follows:'
1. This summary vacation is made under the provisions of Chapter 4, Part
3, Divisi'on 9 of the Streets and Highways Code of the State of
California.
2. The City Council hereby finds that the date of dedication, February 27,
1987, is less than five years and more than one year immedi'ately pre-
ceding this proposed vacation, and that the storm drain easement was not
used continuously since the date of dedication.
3. The City Council hereby declares that the following described drainage
easement is hereby vacated:
See attached legal description titled "Exhibit A."
4. The City Clerk of the City of poway is hereby directed to cause a cer-
t ifi ed copy of thi s reso 1 ut i on to be recOrded in the offi ce of the
Recorder of San Diego County in accordance with the provisions of
Section 8336 of the Streets and Highways Code.

Map No. 15S0S filed ,in the: O'ffi'ce of the County Recorder of San Diego County on
September 21, 19S9, the sfdeline's of said' eas'eiTIent lying 10.00 feet on each side

Commencing at the Northwest corner of said Parcel No.5, said point being in the
